Momentum toward “New Indonesia” is just beginning. We observed some progress on legal process and judicial reforms, since Indonesia’s parliament amended the statute for the first time in 1999. Executive, legislative and judicative body are more equal on power sharing, and they build check and balance mechanism to reduce inequalities in the future. The new statute regulated public participation on legal process and access to justice in a better way. However, we need longer time and more resources to complete the reformation on judicial system, and it’s exciting to follow the development of law in Indonesia.
Indonesia’s judicial progress after statute amendment
Indonesia is a united state in form with republic as the system of government. Before the down of Suharto’s era in 1998, government are powerful, and they had said that the statute (UUD 1945) will remains in its state for ever. After that, the era was changing and all of social components were rearranged. Recent Indonesia’s parliament amended the statute for the first time at 1999, and many consequences on judicial system follow and needs to re-arrange or even for additional amendment. The parliament amended Indonesia’s statute in gradual and partial ways. They chose this way because of some limitations and regarding the priority scale. Indeed its opens to inconsistency.
By the first amendment, Parliament changes the rule of conduct among executive, judicative and legislative bodies. After that, they changes Indonesia’s government system to become more decentralized and reduces the administration power of central government. They also change human rights regulation to become more respective and accessible for inhabitants. This grows many independent institutions considering more freedom of expression. Our journey is still long to ideal concept of democracy and equality, however, we have included some aspects of this concept to our statute, and it’s better than never.
